Marbury v Madison - Past dick moves by John Adams cannot simply be ignored even if Thomas Jefferson becomes president and goes predictably mad with power so long as John Adams was being a dick in an official federal capacity. Oh and John Marshall found this new part of the Constitution that he -John Marshall -had just made up. It let the Supreme Court (coincidentally now led by John Marshall) settle this type of dispute. And Marshall could decide in favor of the president who appointed him and that was fine.
